Eligibility

To use our services, you must:

• Be a registered business entity in the United States
• Have been in business for at least 6 months
• Have a minimum monthly revenue as specified in your application
• Provide accurate and complete information
• Be authorized to enter into binding agreements on behalf of your business

Application Process

Our AI-powered system evaluates applications based on various business metrics. Submitting an application does not guarantee approval or funding. All funding decisions are final and at MCAF's sole discretion.

Merchant Cash Advance Terms

A merchant cash advance is not a loan. It is a purchase of your future receivables. Key terms include:

• Purchase amount and total repayment amount will be clearly disclosed
• Repayment occurs through daily or weekly debits from your business account
• Repayment amounts may be a fixed percentage of daily sales
• Early repayment may be subject to specific terms in your agreement
• Default or non-payment may result in legal action and impact your credit

Representations and Warranties

By applying, you represent and warrant that:

• All information provided is accurate, complete, and current
• You have the authority to bind your business to agreements
• Your business is in good standing and not in bankruptcy proceedings
• You will use funds for legitimate business purposes only
• You will maintain adequate business operations to fulfill repayment obligations

Prohibited Uses

You may not use our platform to:

• Submit false, misleading, or fraudulent information
• Attempt to manipulate or circumvent our AI evaluation system
• Use funds for illegal activities or prohibited business types
• Resell or transfer funding to third parties
• Interfere with platform security or operations

Intellectual Property

All content, features, and functionality of the MCAF platform, including our AI algorithms, are owned by MCAF and protected by copyright, trademark, and other intellectual property laws.

Limitation of Liability

MCAF shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

Dispute Resolution

Any disputes arising from these terms or use of our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the modified terms.
